1. Acceptance of Terms
By accessing or using 2SMTP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
2SMTP provides an HTTP-to-SMTP email relay. You provide your own SMTP credentials, and we relay the emails you submit through your own SMTP provider. Message content is processed transiently for delivery only; after delivery we retain only minimal metadata (a recipient count and a hash of the subject line) as described in our Privacy Policy.
You are the sender. 2SMTP is a technical conduit. For every message you submit, you are the sender of record and the data controller for your recipients' personal data; 2SMTP acts only on your instructions to relay the message.
3. Account Responsibilities
- You are responsible for maintaining the security of your account credentials and API keys
- You are responsible for all activities that occur under your account and API keys
- You must provide accurate information when creating an account
- You must be at least 18 years old to use this Service
- One account per person or legal entity; creating multiple accounts to collect promotional credits is prohibited
4. Prohibited Uses - NO RESELLING
RESELLING IS STRICTLY PROHIBITED
You may NOT resell, redistribute, or sublicense access to 2SMTP to third parties. This includes but is not limited to:
- Offering email sending services to others using your 2SMTP account
- Charging others to send emails through your API keys
- Creating derivative products or services that wrap our API for resale
- Sharing API keys with third parties for their own use
Additionally, you may NOT use the Service for:
- Sending spam or unsolicited bulk email of any kind
- Sending to recipients who have not given you consent appropriate to your jurisdiction, or to purchased, rented, or scraped email lists
- Sending phishing, malware, or fraudulent content, or impersonating another person or organization (including header or sender spoofing)
- Harassment, threats, or illegal activities
- Circumventing rate limits, quotas, or abuse controls (including by distributing sending across accounts or keys)
- Any activity that could harm our infrastructure, our reputation, or other users
5. Your Legal Compliance
You are solely responsible for ensuring that every message you send through the Service complies with all laws that apply to you and your recipients, including without limitation CAN-SPAM, GDPR, ePrivacy, CASL, and equivalent laws in other jurisdictions. This includes, where applicable:
- Having a lawful basis (such as consent) to email each recipient
- Including any legally required sender identification and postal address
- Honoring unsubscribe and objection requests promptly
- Responding to your recipients' data-protection requests as their data controller
2SMTP does not and cannot review your messages for legal compliance. We may, however, act on abuse signals and complaints as described in Section 10.
6. SMTP Credentials and Your Provider
You are solely responsible for the SMTP credentials you provide. We encrypt credentials at rest, but you acknowledge the inherent risks of providing third-party service credentials. We recommend dedicated SMTP credentials or app passwords rather than your primary email password.
Your use of an SMTP provider through 2SMTP remains subject to that provider's own terms and limits. We are not responsible for actions your provider takes β including throttling, blocking, or account suspension β and relay credits are not refunded when your provider rejects or fails to deliver mail.
7. Credits, Free Credits, and Payment
- Credits are pre-purchased and non-refundable except as described in our Refund Policy or where required by law
- Credits never expire and have no cash value; they meter relay volume through 2SMTP only
- Each recipient (TO, CC, BCC) counts as one credit
- All payments are processed securely through Stripe; we never see your card number
- Prices are in USD and may change with notice; already-purchased credits are unaffected by price changes
- Promotional credits (including the 50 free signup credits) are a revocable courtesy: they may be adjusted, withheld, or removed for accounts that violate these terms, and they carry no cash or refund value
- Initiating a payment dispute or chargeback for credits you have already used is treated as a violation of these terms; contact us first and we will work with you in good faith
8. Rate Limits
We enforce rate limits to protect your SMTP server's reputation and ensure fair usage. Current limits are published on the Pricing page and may be adjusted to protect the Service. Attempting to circumvent rate limits may result in account suspension.
9. Service Availability and Deliverability
We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for damages resulting from service interruptions. We reserve the right to modify or discontinue the Service with reasonable notice where practicable.
No deliverability guarantee: whether a message reaches an inbox depends on your SMTP provider, your sending domain and its configuration (SPF, DKIM, DMARC), your content, and your recipients' mail systems β none of which 2SMTP controls. A relayed message consumes a credit even if the receiving system later filters or bounces it.
10. Abuse Handling and Account Termination
- We monitor operational metadata (such as sending rates, recipient counts, bounce and complaint signals) β not your message content β to detect abuse
- We may suspend sending immediately, with or without notice, when we reasonably believe an account is violating these terms or endangering the Service
- Promotional credits are forfeited on termination for cause; paid, unused credits are handled per our Refund Policy
- You may delete your account at any time from Settings, subject to the deletion process described in our Privacy Policy
- To report abuse originating from the Service, contact us via the Contact page
11. Indemnification
You agree to indemnify, defend, and hold harmless 2SMTP and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: the messages you send; your recipients or recipient lists; your violation of these terms or of any law; or your infringement of any third party's rights.
12. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
13. Changes to Terms
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.
14. Governing Law and Disputes
These terms are governed by applicable law. Before pursuing any formal dispute, you agree to contact us and give us 30 days to work toward an informal resolution. Any dispute that cannot be resolved informally shall be resolved through binding arbitration on an individual basis; claims eligible for small-claims court may be brought there instead.
