Terms of Service

1. Acceptance of Terms

By accessing or using Remail Chirho ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Remail Chirho provides an HTTP-to-SMTP email relay service. You provide your own SMTP credentials, and we relay your emails through our API. We do not store email content beyond what is necessary for delivery.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate information when creating an account
• You must be at least 18 years old to use this Service

4. Prohibited Uses - NO RESELLING

Additionally, you may NOT use the Service for:

• Sending spam or unsolicited bulk emails
• Sending phishing, malware, or fraudulent content
• Harassment, threats, or illegal activities
• Violating CAN-SPAM, GDPR, or other applicable laws
• Sending to purchased or scraped email lists
• Any activity that could harm our infrastructure or other users

5. SMTP Credentials

You are solely responsible for the SMTP credentials you provide. We encrypt credentials at rest but you acknowledge the inherent risks of providing third-party service credentials. We recommend using dedicated SMTP credentials or app passwords rather than your primary email password.

6. Credits and Payment

• Credits are pre-purchased and non-refundable
• Credits never expire
• Each recipient (TO, CC, BCC) counts as one credit
• All payments are processed securely through Stripe
• Prices are in USD and may change with notice

7. Rate Limits

We enforce rate limits to protect your SMTP server's reputation and ensure fair usage. Attempting to circumvent rate limits may result in account suspension.

8. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. We are not liable for any damages resulting from service interruptions. We reserve the right to modify or discontinue the Service at any time.

9. Account Termination

We may suspend or terminate your account at any time for violation of these terms, suspected abuse, or at our sole discretion. You may delete your account at any time. Unused credits are not refundable upon termination.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

11. Changes to Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.

12. Governing Law

These terms are governed by applicable law. Any disputes shall be resolved through binding arbitration.
